Yes, it can be done. Basically, you have to show that the work experience is at least the equivalent of a College degree. There are people, called "evaluators" (or something like that) that analyse all the credentials and work experiences to determine that equivalence. Immigration attorneys know how to use those "evaluators" whose "evaluations" are usually accepted by USCIS.

I am trying to get a green card for the US. My parents are from east asia and I was born in Canada. I went to University in Maryland from 1992-96 and obtained my dental license. I am licensed in the US and intend to purchase a dental office soon. I will still be keeping my dental office in Canada for at least 1 year once I am able to work in the US. I heard about a investment visa however I am not investing more than $400k but it will employ at least 4 US nationals(ctizens). Can I still use the investment visa or can I get a visa for opening a secondary dental office in the US and still keep my existing office in Canada until I qualify for a green card. It's H-1B season and the business immigration attorneys at Fong & Chun are busy once again fielding phone calls and inquiries regarding employment-based visas, including those of L-1 and new company visas. In the past few years, the USCIS and US Department of Labor have suspected newer and small companies of fraud, especially within the immigration system. New procedures and increased scrutiny (http://www.immigrationvisaattorneyblog.com/2009/04/h1b-quota-still-open.html) of employment-based cases have made H-1B petitions and H-1B visas especially more difficult to attain.

The DHS now has an unit attached to it which investigates corporations suspected of defrauding the government specifically through the H-1B program and other visa categories. Hello all,
I received an RFE for employment verification. My ETA 750 list Occ Code as 15-1061 (Title - database Administrators). But in my new job I am working as .Net developer where I work with front end and back end development of their website. I work in C#, ASP.NET, java, Flash.
My attorney asked me to find tasks matching with O*net description of Occ Code 15-1061 . None of them directly relate, but some or part relates. Am I in trouble because I no longer work in database development.

Since there is a mad rush of i485 applications , USCIS is going to do lottery to select applications for approval.Rest of them will be rejected.

I am July 3rd RD, 485 EBe Filer. My wife received her EAD. We had our FPs done and all cheques cleared.
My status shows that my application has been transferred from Nebraska to Texas on Sept 6th.
However, I am yet to receive my EAD.
I made an Infopass appointment for interim EAD. Is there anyone in the same boat?

As all PD are now current, number of EAD filling will increase. So the processing time will be about 6 months for EAD.
My question is what will happen, if the PD retrogress before EAD is approved. Will it be still approved, or will have to wait till PD get current again.

Do not do that !! Its a part of the initial evidence andyour application can be rejected based on that.
You can ask her parents to take an afidavit, scan it and send it to u ....

I would like to know that can I apply for EAD extension for me and my wife since my I-140 application was denined last year. We have already appeal for decision on I-140 application to AAO office. I am intend to get my wife's EAD extended by year end.

Is your 485 also denied? Most of the times when ever 140 is denied then the underlying 485 also gets denied and if that is the case then you cannot apply or extend for EAD or AP until your appeal is pending with AAO. I may be wrong so consult an attorney.

I have applied I485 when i was in India and it is in pending now.I am back from India and currently in USA now and came to know that one cannot file I485 when the applicant is not in USA.
Should i be withdrawing the pending I485 and reapply now ?since there is a date availability till august 17th 2007
Or Can I appply new I485 without withdrawing the pending I485 .Once I get new receipt notice ,then withdrw the old pending I485?
Please suggest .Thanks in advance.
These are critical decisions and you should consult a knowledgeable attorney ASAP to know your options and possible risks. If you used an attorney to file your 485 from India, then you know that this attorney is no good.

Hi All,
I have a strange issue, paining me since I have joined this new company, ( I am using AC21, since I am on EAD and AC21 is not yet filed). I am one of those unlucky fellows with really long name(First Name) stuck on my passport, and I have been using this all along, as my legal name while applying for visa/485 related activities. However, I go by the last part of the First Name and so all my other records here (like DL, SSN card, Bank Accounts, 401K account, etc) have got the last part of the First Name as my first name.My H1-B visa had the complete first name printed on it, and so I have been thinking, people could see that the name I have been using is in the last part of the complete First Name on the Visa and Passport.
However, in the EAD card, the name got cut(or incomplete) as the entire first name could not be printed on it. When I showed this to the new employer, they are using the name as displayed on the EAD card(which is not what I go by) in all the accounts they are establishing, like Paycheck, 401K info, ESPP etc.
Now I am in a soup, I have requested them to use the last part of the first name, which they are chcking with their immigration lawyers. But in the meanwhile, I want to know, does any one has this kind of problem. What should we do if the name is incomplete on the printed EAD card? (Ofcourse once I get GC, I would rather change this damn name)
Any one has any ideas?

I was checking the availabiltiy of dates for H1 stamping and came up with following question..
Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*
My wife came to USA on H4 and recentlly moved to H1.... We are planning to get her visa stamped...now my Q is same class of Vsia means any H visa like H1,H4 falls under H class of Visa...

I have read around here about some people sending in their applications earliert then the recommended 120 days and they all got receipts so don't anticipate any issues with that. As far as photo's are concerned you don't have to send any photos with your efiled Ead since you will be called for a finger printing and photo session but for AP you need to send pic's and don't forget to write your A# behind the photos. Hope this helps. Read the link below for more info on what you need to send for AP and for EAD you will get a list of doc's they require once you are done filing online.

I am in my 5th year H1b, my past efforts for GC have messed up. Now i am waiting for PERM withdrawal since Jan 09 to file a NEW PERM. Even if i am able to file a new PERM application by this month or next, what are the chances of getting it approved looking at the current scenario of economy and job market? :confused:
