Hi ,
I attended H4 VIsa intervew recently at Chennai,India and got Green 221(G) asking for some documents from petitioner. Meanwhile my husband changed the employer and got new I797.
Now at the time of submitting the documents, I understand that I need to submit new I797. But what about the documents stated in 221(G), Do I still need to submit them? If so which petitioner's documents do I need to submit? Old one or new one? As the query was mainly about petitioner and now that the petitioner is changed , do I still need to submit them?
Please advice.

concurrent filing means filing of I-140 and I-485 together not two I-140s.
why do you want to put false data on your profile? such as EB1 at Perm stage with 2000 priority date?

Make sure you do not travel out of USA before you get your approved AP, since as per the law if the person who filled I485 leaves the country without AP then it is considered that he abandoned his I485, with the exception given to H1B/H4 and L1/L2 (and youdont have any of these)
If you leave USA without AP then you need to restart the process, if you have AP then that is all you need to travel.

You should just provide a valid reason for your case for the senator to help. All senators have direct lines to immigration offices. They can expedite your case and the results are astonishing.
My cousin left to india for an emergency and his AP was pending. Contacted senator and got it approved immediately in a day.
I also heard that one person got his 140 approved in a week. Not sure what reason he provided.
But senators are certainly helpful unlike Indian politicians.

Hi,
Any cases where the underlying I-140 was withdrawn after 180 days of the 485 being pending(changed jobs using AC21) got approved recently?
I am current as per the July bulletin and would appreciate if some one else who is/was in a similar situation can provide their updates.

I heard that it is pretty easy there. 2 years back One of my friend got 10 year multiple entry visa from singapore. He has told me that there was no queue in american consulate in Singapore.

Hi,
Myself and my wife applied for 485, 765 and 131 on Aug 13th and we got receipt notices on Oct 5th.
But we got only 485 & 131 for my wife and i got 765 and 131.
485 Receipt is missing for me and 765 is missing for my wife.
We haven't got any mail today also i.e. Oct 6th. Any thing similar happened to anyone?
When we will get other receipts. If at all they are missing can we contact USCIS to send them again?

My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. I think most the news that H1B's are turned back @POE are not ture. My wife just got her second H1B stamped at kolkotta embassy ( end of jan) and we came back through JFK on Feb 14th. I am on my second H1B. Not a single question was asked. Again Not a single question was asked for first time. Before they used to ask the name of the employer or ur position. We both are permanent employees for a big company ( think of iPhone) and done our MS here. based on my recent experience I do not see any problem with you.

My wife is a Canadian citizen, what is the process of getting a H4 for her? (I am on an H1-140 approved).
1)Do I file an app with USCIS?
2)Can she go apply at the US consulate in Canada?
What type of documents, forms are involved ?
The reason for this post is I was given conflicting info by my old lawyer.

Your wife should take an appointment at the closest US Consulate. She and you should then look up the list of documents needed on the website of that US Consulate.
thats how I did it for my wife but she was from India.

Stick with your wifes country dates. The dates in India wont be stable for long.
I requested(May 02nd) them to approve my case using "Cross-Chargeability", since my wife was born in non-retro country. But from June 01st, my PD (India) also becomes current. I really don't know what to do now?

so it looks like the only way out for a prospective indian investor would be to start his enterprise outside usa, get employed in it for 1+ yr, then enter the usa on L1 and apply for GC under EB-5 category?

I always wonder these ARAVAS deserve GC?
Because where ever they will make lot of fuss there and cause so many troubles to hosting country...
Srilanka they made a beautiful country as almost ash because of their perverted intensions..And Singapore they will never go with country's best interests...and Malaysia....
And even in India see the support to LTTE (Openly)
Also all most all these ARAVAs are blue collar cheap labor, I don�t know how a considerable number of Tamils getting h1b
