My dad wants to visit the U.S. Who would be better to sponsor him ?
Me or his brother ?
Also, if his brother sponsors him, would the consulate ask why are you not using your son's papers ?

You must get paid by your H1B employer. Middle or another middle is not valid on the face of the law. You cannot ask any one other than your employer for pay also. If you didn't get your salary, file a complaint agaist your employer with the labor department. Do not mention about any entity other than your employer. You have no right to interfare into company matters.
Recently my employer written a mail saying that he is closing the company and said to look for new employer.Previously i am working through a middle layer.When i found new employer he directly approached main vendor regarding contract.Now i am working without middle layer.Mean while middle layer hold my 45 days pay .The middle layer is not willing to pay.It is almost 8 months.I worked more than 20 months through middle layer.Can i get my money back?The middle man Threatening saying there is contract which you cannot go and it is breach.Can you please advise.

1. What happens to old passport. I took Appt with old passport number?
2. Can I keep my old passport?
3. Is it OK to go for new renewed passport? Or will it impact the H1B stamping and interview process?

Hi Everyone,
I need help urgently , my port of entry is SFO and on the I94 I have not written my complete name as I didn't understand the the importance of I-94 . When I tried to apply for SSN i was told that the names has to match with the name written in I-94 at the port of entry and the person said that I have no other option to change the name so I agreed upon the name which on SSN . Now I googled out and came to know that I can change the name in port of entry . It would be of great help for me if any one can help me out getting out of this situation .

you can enter the country even a day before your visa expires, but the main thing here is the i-94 stamp where the immigration officer puts the duration of your stay...it will be till your visa expiry date. so it is better for you to have an approval for the extension so that you can get to stay till the expiry of your visa. do premium processing or something, you still have time...

We recently assisted a client from Johannesburg, South Africa, regarding an H-1B specialty occupation visa. He was approved for an H-1B visa, but in order for our client to enter the United States, he must obtain an H-1B visa in his passport. Because the chances of visa issuance vary greatly depending on documentation and individual circumstances, we suggested that he go to the interview at the U.S. consulate very well prepared. We told him to take a certified copy of his entire H-1B package that was filed with the Immigration Service, along with his Form I-797 Approval Notice. We also suggested that he take original birth certificates, marriage certificate, and proof of financial support. He attended the interview this morning and his experience at the U.S. consulate in Johannesburg, South Africa was documented as follows.
“My wife, myself and our son had our interview at the U.S. Consulate here in Johannesburg this morning, at 9:00am. I went to Infopass to enquire about my interfile status. The first level officer said since my PD is not current, she will not allow me to meet the IO. I argued that PD has nothing to do with knowing the status and allow me to meet the actual IO. she still did not. What a crap !!!

My employer applied for H1 extn last year (sept'08) and after my project ended in Nov'08, I left to home country in Dec'08 (I-94 expired)and I recently came back on H4. I heardfrom my employer that I got an RFE asking client letter and due date was May 4th. He did not respond since I didn't have project. Now I am in the process of project confirmation, and I have to be on H1 to start working again,
1) Do I have to apply for new H1 (non-cap) or just apply for H4 to H1 COS or both? if 'both' then can I apply both in one package under PP? Can I start working on receiving receipt number?
2) Can I apply H1 with the same employer, will there be a problem since he did not respond to RFE before? or can I apply for H1 transfer to a different employer using the previous H1 receipt number(is the receipt number still valid) or apply for new non-cap H1?

I have got my I 485 rejectd when i filed during AUG 2007 due to Improper fees but we paid the correct fees.We refiled with saying "Improper Denials of I-485 " and double packed saying byboss mail room. We tryied more than 5 times always we got back saying PD is not current. Please advice me how to proceed on this.

I think the mail room does not handle such mail. You may need to file an MTR. Contact a good attorney - I did read on Sheela Murthy's website that USCIS is improperly handling the July 17th to August 17th 2007 filing as they go by August 2007 fee schedule.
I think if it is a mistake on their side, usually theey return the MTR fees. I am not sure though.
Try contacting DHS Ombudsman's office and see how they can help.
But the first thing I suggest is to talk to a good Attorney.

- Graduated in 1996 after 4.5 years at a non-US University
- 1996, worked 2 years in company A as an embedded software designer
- 1998, worked 6 years in a fortune 500 company as an embedded software engineer.
defended my thesis and got my BSEE diploma/certificate (a.k.a Titulo or Title in english)!!!!.
- 2005 - present, working with my current US employer under H1B.
Despite the fact that I worked as an engineer since 1996 with just the course completion certificate (in my country that�s the only document you need to start working as an Electrical Engineer but not so for other engineering or professional disciplines) the issue is that I defended my thesis in 2005 so I could obtain the official diploma which was a requirement for my H1 visa.
My current employer is planning on opening a new job position that would require a MS degree or BS+5 years progressive experience, in other words the so called EB2 job requirements. Do I qualify for that EB2 position?, Would the experience I have since 1996 count as progressive experience?, should I wait for an EB3 position instead?

You can certainly file for EB-1 or EB-2 based on the job discription. You will need to file new LC/ I-140 in the respective category and once approved you can port your earlier PD.
