Hi, I have a question.
1. My colleague crossed 2 years after filing 485. Frustrated with GC processes, he is switching company for better career prospects. He is using his EAD and invoking AC21. Is it possible for me to use his labor? If no, why?

Yes, a transfer could be filed while an extension is pending. This is the so-called anchor transfer. However, the transfer would be denied if the extension petition is withdrawn before the transfer is approved.
The 140 approval notice is not required unless this is a post six year transfer/extension.

Hi,
On the USCIS website, it mentioned "normal processing time" in the following statement. I am wondering what is the normal processing time for I-485. I can't find it. When the published processing time is current for a case, how long it will take for a case to be approved?
My case suddenly becomes current for a month with the sudden forward movement of the processing time. I am wondering how long should I wait before I contact USCIS about my case if I do not hear anything from them.
When is name check initiated? When the case is received or when the case processing time becomes current?

TSC online system seems to be still down - I tried adding a new receipt number and its not accepting, I talked to my lawyer and she mentioned that she heard same from a bunch of her other clients. Since my EAD is still valid for another couple months, I didnt try to go for InfoPass yet.
These days people are getting RFE's left and right and TSC's online system is down just in time :( In many cases it may not be a big deal (to answer the query in time) but having online system updates was useful to prepare for any such thing. Now we have to wait for the letter.

Hi,
I'm trying to schedule my visa stamping date in aug /sept time frame in India. In delhi consulate when I click on Indian resident I see the available dates but when I click on Indian citizen residing in US, I see no availability. I'm not sure which option should I choose. I'm a student working on OPT in US. My OPT will expire on Aug 4th and so I will come to India. I'm not sure which of the two options I have to choose while scheduling an interview :
Resident of India/Bhutan
OR
Indian Citizen residing in United States.
I would really appreciate any help in this matter.

I was in Canada and came back to US last weekend using AP. I only had two documents. They asked for three but I told them that I only have two and that is all I got from USCIS.
They made me wait for 15 minutes and then stamped both AP documents and gave it back to me with an I 94 and entry date/stamp.
I believe you should have your Advance Parole document and not with the immigration.

some where i read in the forum if we leave the country without the approval of ap our 485 status will be abonded.
If you leave the country after getting your I-485 receipts then its okay whether you get your Advance Parole papers or not since you are going for H1 stamping and are not going to use AP anyway.
It does not matter. Some people do not even file for AP if they are going to use their H1 visa to re-enter the country.
But remember your I-485 receipt is very important. Always keep it handy ( do not leave without it ):)

are there any approvals from TSC lately ? since the online status is down, there is no way to get status updates now. Worse yet we don't get notifications on RFE's and if the lawyer did not notify on time, this is going to be a disaster..

My labour was filed for a software engineer position (java, udb, etc) 3 years ago. Over that time, my role has changed to a project manager. Infact I don't do any coding anymore. If I invoke AC21 after 180 days, can I switch to a Project Manager position?

Hi ,
I want to change my wife's H1 to H4.
She got her first approval in oct 2006 and was working as fulltime. after that she coverted to H4 when we visited india. her H4 is valid through oct'09. then we file for her new H1 from company B in march 09 (COS) and she got approval but due to bad market condition she never got project and her consulting company never paid her so she doesn't have any paystubs. My company file for my H1B extension and I got approval.
Now I want to change my wife's status back to h4. I had in impression that she never worked on new H1 so her H1 will not be activated. but I came across some posts and learn that it is automatically activated the day she got her H1B approval.
Now please suggest me what would be the safest way to convert her back on H4 ?
1)File form I-539 without her paystubs using my new 797 document? is there chances of RFE without paystubs? and what could be the next step if RFE comes? can we go to home country and get it done or it will make more complications? and VO will ask more questions because of RFE?
2) go out of county and come back again on existing stammped h4 (I am hoping that will convert her status back to H4)? and then file for I-539 for H4 extension using my new Approval notice? she has canadian PR as well. should she visit canada or india? somehow her I94 on passport has expired in Feb'09 but she has valid I94 on her H1 pitition. should she give her new I94 when going out of country? if she visits canada will they issue her new I94 if she returns back within 30 days?
