Hi-
My current EAD was issued in 2007 when I filed I-485 + I-140 concurrently. It has since expired. I did not apply for a renewal because I am still on my H1B.
I am applying for a renewal now and had a question regarding filling out form I-765
Q15. Current Immigration Status ( Vistor, Student, etc )
I am still on my H1B. So I think I should write H1B and not AOS. But I am not sure.
I filled (C)(9) for Q16 Eligibility Criteria, and since I live in Ohio I am sending it to USCIS Phoenix Lockbox Facility. My receipt notice is Aug 2007 and to be sure I am including the $380 fee.

I have an approved I-140 from my previous employer. Is there anyway, I can expedite my labor certification, I-140 approval and I-485 through my new employer on the basis of the previous approvals? I have a PD of jan'04. I know I retain my PD due to the I-140 but I wanted to know if there is anyway to not wait for the time it takes to get approval on LC and I-140.
no labor is position dependent not person dependent. You cannot make it go faster based on earlier 140.

My company is using substituted labor for me and applying for 140 and 485. My original LC which was pending just got approved. But the physical documentation is not there.
But my company is saying that they will also apply for 140 for the original LC also. How is this possible? I'm confused. What will happen to the 485 (and the first 140) when they file second 140?

Please be careful. some days back some of my friends caught up with this substitute LC and lost money. Please be careful before investing any kind of money esp if it is for desi body shoppers. USCIS is taking strict major and many substitute LC are getting rejected. so be cautious

I believe so....if your LC is approved in August, then your PD is August. It is not qualified under July VB.
Not True. PD is your labor filing date not approval date. I think, you should be able to apply if your PD falls on or before July 2007. Please consult with your attorney. They can check with USCIS through AILA liason. Thanks -

If I file my I-485 during the next 2 weeks and assuming the super number of filings, what is an approximate date for fingerprinting. My wife has to visit India for her sister's marriage in Oct-Nov time frame.

Mods, please remove my post (and maybe it would make sense to create threads specific to the USCIS/DOS mess up to - at the moment it does not look very organized to me and it is hard to find information. Maybe sub-threads with "law suit", "publicity" would channel comments better?)

I only read about an article in two online newspapers but believe this whole topic should get significantly more attention. I do not know if that is going to help to get this started but I sent an e-mail to our local TV stations and hope that some may be interested and even pick it up. Again, no idea if this is going to work but I assume that if they get more e-mails regarding the same topic, interest will come up....

With having many international operating companies in the U.S. who all employ legal alliens who are going through the "greencard process" to become legal permanent residents, the Department of State (DOS) and the U.S. Citizenship and Immigration Services (USCIS) have destroyed many plans, caused significant financial loss for applicants and very likely acted against the law. I think this would be well worth a few minuted report - everybody is talking about the pain that the illegal immigrants go through but (without taking away anything from that), the pain of legal alliens having to deal with the willful behavior of USCIS and DOS is not much better.

Well that is quite simple isn't it?
If you have an object selected you see at the left "Position"
Click on that and then click on move pivot only, then you can move your pivot to the right and let it rotate differant
